Terms of Service

These Terms of Service form the agreement between you and PickMyAlbum. By creating an account or placing an order, you accept these terms. Please read them together with our Privacy Policy and our Returns, Refunds & Delivery policy.
1. Acceptance of these terms
By creating an account or placing an order, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the service.
2. Eligibility & age
You must be at least 13 years old (16 in some EU countries) and able to enter into a binding contract to use the service. By using it, you confirm that you meet these requirements.
3. Your account
You are responsible for keeping your login credentials secure and for activity that happens under your account. Please give us accurate information and keep it up to date, and tell us promptly if you suspect any unauthorised use.
4. Acceptable use
You agree not to upload unlawful content, infringe anyone else's rights, misuse the service, or attempt to bypass rate limits or security controls. You are responsible for ensuring you have the right to upload and print the photos you provide.
5. Your photos & content licence
You keep full ownership of your photos. You grant PickMyAlbum a limited licence to store, process, and organise them solely to provide the service — including AI-assisted organisation, album layout, and print fulfilment — and the licence ends when you delete the content or your account. By uploading photos, you confirm that you have the right to use them; where the photos show other people, that you have obtained any necessary permission; and where they show children, that you hold parental responsibility or have appropriate authorisation. We use your photos only to fulfil your order and provide related support — never for marketing, our portfolio, social media, or to train AI models without your separate, explicit consent.
6. AI-assisted photo selection
Our service analyses, organises, and selects from the photos you upload — with the help of artificial-intelligence tools — to create your personalised printed album. The AI is an assistant in the curation process: it helps identify, for example, duplicate, blurry, or poorly framed photos and those best suited to the album format, considering factors such as sharpness, framing, lighting, variety, and facial expressions. You review and can adjust the proposed selection and layout before placing your order, so the final album is produced to the selection you approve. The quality of the final album depends on the quality, resolution, and characteristics of the photos you provide. Your photos are analysed on our own systems and are not used to train AI models.
7. Orders, printing & payments
Album prices are shown in euros (EUR), with VAT included. Payment is processed securely by Stripe; we do not store your full card details. Printed albums are personalised goods made to order based on your selection. Your order is confirmed once payment is completed. 8. Subscriptions & photo capacity
We offer a Free plan and paid plans — Plus (€1.99/month) and Pro (€2.99/month) — that increase your photo capacity. Paid plans are billed monthly and renew automatically until cancelled. You can cancel at any time through the billing portal; access continues until the end of the paid period. See our Returns, Refunds & Delivery policy for refund details.
9. Intellectual property
The PickMyAlbum software, brand, and site content are owned by us or our licensors and are protected by law. These terms do not transfer any of those rights to you.
10. Disclaimers & limitation of liability
The service is provided "as is". To the extent permitted by law, we limit our liability for indirect or unforeseeable loss. Nothing in these terms removes or limits your mandatory rights as a consumer under Portuguese and EU law.
11. Suspension & termination
We may suspend or close an account that breaches these terms or the law. You may close your account at any time. On closure, your stored content is deleted in line with our Privacy Policy, and any orders already in production will still be completed and delivered.
12. Complaints & dispute resolution
If you have a complaint, please contact us first at support@pickmyalbum.com so we can try to resolve it. As a consumer, you may also use the electronic Complaints Book at www.livroreclamacoes.pt. In the event of a consumer dispute, you may turn to an authorised alternative dispute resolution (ADR) entity: the National Centre for Information and Arbitration of Consumer Disputes (CNIACC), www.cniacc.pt, which has national jurisdiction, or the consumer-dispute arbitration centre for your region. More information is available at www.consumidor.gov.pt.
13. Governing law
These terms are governed by the law of Portugal. This does not deprive you of the protection of mandatory consumer-law rules of the country where you live.
14. Changes to these terms
We may update these terms from time to time. If we make a material change, we will notify you in advance and update the "Last updated" date above. Continuing to use the service after a change means you accept the updated terms.
